How to Decide: Six Honest Questions to Ask Yourself

Before you spend money on debt relief services or file anything, walk through these questions. The answers usually point clearly to one path.

1Can I realistically pay off my debts within 5 years on my current income?

3Do I have a foreclosure date, repossession notice, or active lawsuit?
4Do I have a meaningful lump sum (savings, family help, tax refund) available now?

Watch Out: Debt Relief Scams

The debt relief industry attracts a lot of legitimate help and a lot of predators. Robert sees both. Red flags to walk away from:

  • Upfront fees before any work is done. Federal law (the Telemarketing Sales Rule) prohibits this for debt settlement firms.
  • Promises to "remove" accurate negative items from your credit report. Not legally possible.
  • Pressure to stop paying creditors and route money to them instead. This often triggers lawsuits before any settlement happens.
  • "Government program" pitches. There is no federal program that erases credit card debt outside of bankruptcy.
  • Refusal to disclose total cost in writing before you sign.

When Bankruptcy IS the Right Choice

If you're facing wage garnishment, foreclosure, or lawsuits — or if your debts are more than you could realistically pay off in 5 years — bankruptcy almost always outperforms the alternatives. The automatic stay is the most powerful debt-relief tool in U.S. law, and a discharge actually clears the debt rather than just rescheduling it.
